1. Agreement to Terms

By downloading, installing, and using the fishMarX application ("App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the App.

2. License Grant

We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. You may not modify, reverse engineer, decompile, or disassemble the App or any of its components.

3. User Accounts

To use certain features of the App, you must create an account. You are responsible for maintaining the confidentiality of your account information and password. You agree to provide accurate and complete information during registration and to keep this information current.

4. User Content

You retain ownership of any fishing spots, catch data, photos, or other content you submit to the App ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display that content to provide the App's services.

5. Premium Subscriptions

Premium subscriptions are managed through the Apple App Store. Subscription pricing, renewal terms, and management are governed by Apple's terms. You can manage or cancel your subscription through your device settings at any time.

• Subscriptions auto-renew unless cancelled
• Cancellation takes effect at the end of the current billing period
• No refunds are issued for partial months or unused portions

6. Account Deletion

You may request to delete your account at any time through the App's settings. Once deletion is initiated, all of your personal data will be permanently removed from our systems within 30 days. User content (spots, catches) may be retained in anonymized form to support the app community, unless you request complete removal.

7. Limitation of Liability

To the maximum extent permitted by law, fishMarX and its creators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including loss of data, profits, or business interruption.

8. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, secure, or error-free. GPS coordinates, tide data, and weather information are provided for informational purposes only.

9. Prohibited Use

You agree not to:

• Use the App for any illegal or unauthorized purpose
• Transmit viruses, malware, or harmful code
• Harass, threaten, or abuse other users
• Reverse engineer or attempt to gain unauthorized access to backend systems
• Scrape or bulk download user data without authorization

10. Privacy

Your use of the App is also governed by our Privacy Policy. Please review our Privacy Policy to understand our privacy practices.

11. Changes to Terms

We may update these Terms of Use at any time. Continued use of the App after changes constitutes your acceptance of the new terms.

12. Governing Law

These Terms of Use are governed by the laws of the United States, without regard to conflicts of law principles.
